THE FUTURE OF MANDATORY ARBITRATION IN CONSUMER CONTRACTS: Has the Tide Finally Turned?

This seminar will address legal issues relating to arbitration in consumer contracts following the Minnesota Attorney General suit against the National Arbitration Forum ("NAF"), and developments in Illinois and federal law on mandatory arbitration in consumer contracts, including class action waivers. At the seminar, you will learn:
- Is your arbitration clause still enforceable if the chosen forum is no longer arbitrating consumer claims?
- Are class action "bans" or waivers in arbitration clauses still enforceable in Illinois?
- Are arbitration clauses in consumer contracts still viable?
- How can consumer claims be arbitrated fairly?
- What is the legal status of NAF arbitration awards after the Attorney General suit?
